October 2026 marks a major milestone in the phased roll-out of the Employment Rights Act 2025 — and homecare providers need to be prepared.

We will cover October 2026 changes, including:

  • Third-party harassment duty — from October, employers must take all reasonable steps to prevent harassment of their workers by third parties such as clients and their families. In a sector where staff routinely work in people's homes, this obligation demands careful policy review and staff training.
  • Trade union rights — new duties to inform workers of their right to join a trade union, extended workplace access rights for union representatives, and new obligations around facilities and accommodation. These apply whether or not your organisation currently recognises a union.
  • Employment tribunal time limits — the window for workers to bring most tribunal claims doubles from three to six months, increasing exposure for employers and underlining the importance of robust HR processes.

And also, the January 2027 changes including:

  • Unfair dismissal – the reduction of the qualifying period to 6 months and
  • Restrictions on variations to contracts (fire and rehire) which limits how you can change your contractual agreements.
