Updated statutory guidance on industrial action

The Government has updated statutory guidance on:

This reflects changes implemented as a result of the Employment Rights Act 2025; key provisions on industrial action came into force on 18 February 2026, including around:

  • Turnout and support thresholds
  • Provision of information to union members
  • Provision of information to employers
  • Notice of industrial action
  • Period after which ballot loses validity
  • Union supervision of picketing
  • Protection against dismissal for industrial action
  • Repeal of minimum service level legislation (as of December)
