Make Work Pay: threshold for triggering collective redundancy obligations

As part of the Employment Rights Act changes, the threshold for collective redundancy processes is changing. Employers used to have to use collective redundancy where 20 or more employees were being made redundant in one establishment. The government will set a new threshold that will cover a whole organisation (with different branches/multiple establishments) rather than this being limited to one establishment. This consultation looks at how high the new threshold should be.

The consultation is open until 21 May 2026. You can find the consultation here.
