Consultation: Trade Union Right of Access
As part of the Make Work Pay Plan, the government has launched a series of public consultations on key measures in the Employment Rights Bill. The Department for Business and Trade has published a series of factsheets sharing further details on the measures included in the Employment Rights Bill.
This consultation focuses on measures will introduce a new framework for trade unions to access workplaces physically, and to communicate with workers in person or digitally.
This consultation is seeking views on:
- How unions will request access.
- How employers respond.
- The factors the Central Arbitration Committee (CAC) will consider when deciding whether access should be granted and on what terms.
- How the CAC is to come to decisions on the values of fines issued for breaches of access agreements.
The consultation closes at 11:59pm on Thursday, 18 December 2025. Click here to submit a response.
