Consultation: Reform of TUPE legislation
The Government is consulting on how to reform the legislation covering TUPE (Transfer of Undertakings (Protection of Employment)). This legislation governs the employment rights of workers that are transferred from one employer to another following a merger or restructuring. Providers use TUPE frequently in the care sector if taking on work from another provider or local authority which was previously delivered by someone else and careworkers are being moved to a new provider alongside care packages. This consultation helps the Government to understand:
- the prevalence of TUPE transfers
- experiences with current TUPE processes
- how to better ensure TUPE is easy to follow for businesses
- how to strengthen the existing set of rights and protections for workers subject to TUPE
- what policy proposals for reform to develop
